Marc D. Cumsky is a partner in the firm,
practicing primarily in the areas of real estate law, affordable housing development, and related disciplines (e.g.,
housing, land use, condominiums, corporations, partnerships, etc.). He has extensive experience in all facets of
commercial lending, real estate development, and multifamily housing.
Marc has been practicing law in the Boston area since 1977. Marc began his practice as an associate with the
Boston law firm of Fine & Ambrogne, where his focus was on commercial real estate transactions. He left Fine &
Ambrogne in 1982, and for the next eleven years (1982-1993) he practiced with the Boston firm of Brown Rudnick Freed
& Gesner, the last seven years as an equity partner. Marc has had his own firm since 1993.
Marc's educational background includes a J.D. (cum laude) from the University of Michigan Law School in 1976, an M.A.
from the University of Michigan in 1974 (in American Studies), and a B.A. from the New School for Social Research in 1971.
Marc is admitted to the Massachusetts Bar (1977) and the United States District Court for the Eastern District of
Massachusetts (1977). Marc is married to Linda Whitlock, President and CEO of the Boys and Girls Clubs of Boston, and
they have two children.
Richard J. Levin is a partner in the firm, practicing primarily in the areas of banking and commercial finance,
real estate and commerical leasing, real estate litigation, and corporate law. Rick has represented many of the major
Boston commercial banks in both real estate and asset-based lending transactions. He serves as outside corporate and/or
real estate counsel to a number of closely held corporations, foundations, and real estate companies and investors.
He has substantial experience in corporate transactions and business planning, conveyancing and title insurance, foreclosure
and asset recovery and creditor/debtor workouts.
Rick has been practicing law in Boston since 1975. After serving for two years as an Assistant District Attorney for
Middlesex County, Cambridge, Massachusetts, Rick joined the law firm of Fine & Ambrogne as an associate, where his focus
was on real estate and bank litigation and bankruptcy matters. In 1981, he formed his own firm, Levin & Berk, which merged
in 1987 with a mid-sized Boston firm, Looney & Grossman. For nine years, Rick was a senior partner at Looney & Grossman,
until founding Heller, Levin, & Seksay, PC in 1995. In February, 2001, he joined with Marc Cumsky, a colleague from his Fine
& Ambrogne days.
Rick is a graduate of the Wharton School of Finance and Commerce (University of Pennsylvania) with a B.S. in Economics
(1972) and was awarded a J.D. from Boston University School of Law (1975). Rick is admitted to the Massachusetts Bar (1975)
as well as to the bars of the United States District Court for the Eastern District of Massachusetts, the First Circuit Court
of Appeals and the United States Supreme Court. He is a member of the Commerical Panel of the American Arbitration Association
and a Trustee of the Boston Area Alumni Association of the University of Pennsylvania. Rick is the co-author of "Commercial
Lending in Massachusetts," National Business Institute, 2002, which received the American Jurisprudence Book Award, Corporations.
Rick is married to Arlene Levin, a Vice President of Eastern Research Group, and they have two children.
David M. Foss is an associate of the firm, practicing in the areas of real estate and corporate law, including secured
lending, commercial and residential real estate development, affordable housing development, and condominium law. Dave has been
practicing law in the Boston area since 1996.
Dave was awarded a J.D. for Boston University School of Law (1994) and a Bachelor of Science (Finance, Cum Laude) from
Northeastern University (1991). Dave is admitted to the Florida Bar (1995), the Massachusetts Bar (1996), the United States District
Court for the Eastern District of Massachusetts, and the United States Court of Appeals, First Circuit.
Matthew H. Pappas is an associate of the firm, practicing in the areas of corporate and real estate law, including commercial
lending and conveyancing. Matt has been practicing law in the Boston area since 2003.
Prior to joining the firm, Matt worked as a real estate attorney in Brookline. Matt earned a J.D. from Northeastern
University School of Law (2003) and a B.A. (English and History, magna cum laude) from Tufts University (1998).
Seth H. Salinger is of counsel to the firm, practicing in the areas of business litigation, intellectual property,
construction law, consumer law, personal injury, criminal defense, and general tort law. Set represents corporations and individual
clients in a variety of business and other matters. He serves as vice president and general counsel to a real estate development firm.
He has extensive experience in all phases of civil litigation, has tried cases in various state and federal courts, and has
represented clients before a variety of administrative agencies.
Seth has been practicing law in the Boston area since 1989. He was an associate at the Boston firm of Looney & Grossman from
1989 to 1996. In 1996, he formed a solo practice. From 1999 to 2002, he was a panel attorney of Suffolk Lawyers for Justice, the
Massachusetts public criminal defenders program for Suffolk County. He joined Cumsky & Levin LLP in May, 2002.
Seth is a 1985 graduate of the University of Massachusetts at Boston (BA, English, Magna Cum Laude) where he won the
Bunselmeyer Prize for Distinction in Language and Literature. He received his law degree from Northeastern University School of Law
in 1989. He is a panel attorney for Volunteer Lawyers for the Arts. He is a member of the Massachusetts Bar Association. He is
admitted to the bar in the Commonwealth of Massachusetts and the United States District Court for the Eastern District of
Massachusetts. He is co-author of "Does a Sincerely-Held Religious Belief Confer a Right to Discriminate?" Boston Bar Journal,
1996. Seth is married to Sharon S. Salinger, a novelist and editor at the New England Journal of Medicine. They have two
children.
Robert D. Keough is of counsel to the firm. Bob has been practicing law in Boston since 1993, and practices primarily in the
areas of corporate and real estate law, including mergers and acquisitions, counseling start-up companies, bank financing, commercial and
residential real estate development, and conveyancing. Bob also has extensive experience in affordable housing development and syndication.
Prior to joining the firm, Bob worked as a corporate/real estate associate at Nixon Peabody LLP and Peabody & Arnold LLP, both of Boston,
and also had his own practice. Bob earned a J.D. from the Boston University School of Law (1993), and also holds a B.A. and M.A. (International
Relations) from Tufts University.
